-And-
In the matter of : Saikat Maity @ Saikat Maiti
… Petitioner(s)
Mr. Siddhartha Sarkar Mr. Sourav Gupta
… for the Petitioner(s) Mr. Lokesh Sharma Mr. Rishav Kr. Thakur
… for the State-respondent(s)
Earlier, bail was obtained from this court by misrepresentation, as such, bail was granted in CRM (NDPS) 1067 of 2026; CRM (NDPS) 1287 of 2026. By relying upon the aforesaid orders, another person was granted bail in CRM (NDPS) 1530 of 2026. Learned advocate for the petitioner as well as the State did not portray proper picture before this court. Having considered that the petitioner relies upon the orders which were passed pursuant to the misrepresentation having been made at least in CRM (NDPS) 1287 of 2026, I am of the opinion that the present case is not a fit case for granting bail to the present petitioner.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1860 of 2026 is dismissed. Pending application(s), if any, is also disposed of. However, Rule is issued in CRM (NDPS) 1287 of 2026 and CRM (NDPS) 1530 of 2026 as to why Bail of the petitioners therein namely, Jaymalya Pal and Selim Sk @ Murselim @ Morselim should not be cancelled. Let, communication be made upon the respective accused [petitioners therein] through the department. Let, records of the said cases be placed along with the service on 16th September, 2026 when the aforesaid matters [CRM (NDPS) 1287 of 2026 and CRM (NDPS) 1530 of 2026] will appear under the heading ‘To Be Mentioned’. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
