Learned advocate for the petitioners submits that the petitioners are innocent and have been falsely implicated in connection with the instant case. The petitioners have also instituted a criminal case, but, inspite of the same, the police authorities are pursuing the case of the informant and not pursuing the case of the petitioners. State has produced the case diary and drawn the attention of the court to the injury report. I find that the doctor opined the injuries to be grievous.
2 Having considered that the petitioner no.2 is a lady, her prayer for anticipatory bail is allowed. So far as the petitioner no.1 [Jahirul Islam] is concerned, his prayer for anticipatory bail is rejected. Hence, the prayer for anticipatory bail of the petitioner no.2 is Allowed. Accordingly, I direct that in the event of arrest, the petitioner no.2 [Rumi Bibi] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner no.2 shall make herself available before the Investigating Officer of the case as and when she would be required by the I.O. till the report in final form is submitted before the learned jurisdictional court. Accordingly, CRM (A) 2913 of 2026 is partly allowed. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
