Learned advocate for the petitioner submits that the petitioner has been implicated in this case only on the basis of statement of a co-accused. Learned advocate for the State submits that there has been recovery of 814 gm of brown sugar. Learned advocate emphasizes that the CDR speaks that the present petitioner was in touch with the other accused person who was maintaining a mobile in the name of his wife [Fatema Bibi wife of Mahibur Sk]. Learned advocate for the Petitioner again submits that in the charge-sheet, the said document has not been relied upon by the prosecution.
2 If that be so, The Superintendent of Police, Malda will ensure that such material is placed before the learned jurisdictional court. Having considered the above, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1912 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
