JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.9 in Crime No.20/2022 registered by Sheshadripuram Police Station, Bengaluru City for the offences punishable under Sections 409, 420, 465, 468, 471, 472, 120-B read with Section 34 of Indian Penal Code, is before this Court in this petition filed under Section 482 of BNSS 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.20/2022 was registered by Sheshadripuram Police Station, Bengaluru City for the - 3 - HC-KAR CNR: KAHC010565392026 NC: 2026:KHC:48278 CRL.P No. 12629 of 2026 aforesaid offences against Smt Rukmini C.S., and others, based on the first information dated 21.01.2022 received from Sri. Ramachandrappa, Police Officer, CHC, Vigilance Cell and BDA Head Office, Sheshadripuram, Bengaluru. After completion of the investigation in the said case, chargesheet is now filed against 11 accused and case is registered in C.C.No.45955/2025 before the jurisdictional Court of Magistrate. The petitioner is arrayed as accused No.9 in the charge sheet. Apprehending arrest in the case he had filed Criminal Miscellaneous No.6481/2026 before the jurisdictional Sessions Court which was rejected on 18.07.2026. Therefore, he is before this Court. 4. Material on record would go to show that the petitioner is not named in the FIR. After completing investigation, chargesheet is filed against 11 persons. Accused No.1- C.S. Rukmini, is said to be the beneficiary of the alleged fraud in which a sale deed was executed in her favour in respect of a site belonging to Bangalore Development Authority. Accused Nos.7 to 10 are said to - 4 - HC-KAR CNR: KAHC010565392026 NC: 2026:KHC:48278 CRL.P No. 12629 of 2026 be the mediators who had negotiated for the said sale. Allegation against accused Nos.7 to 10 is similar in the chargesheet. The petitioner is said to be the son of accused No.8. Further proceedings in the present case have been stayed as against accused No.8 in Criminal Petition No.1716/2025 by the Co-ordinate Bench of this Court. Accused Nos.7, 8 and 10 are said to have been granted bail in the present case. It is submitted that similar cases are registered against the petitioner and his father and in all the other criminal cases, petitioner has been enlarged on bail. Investigation of the case is already completed and chargesheet is filed. 5. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following : - 5 - HC-KAR CNR: KAHC010565392026 NC: 2026:KHC:48278 CRL.P No. 12629 of 2026 ORDER i) The petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.20/2022 registered by Sheshadripuram Police Station, Bengaluru City for the offences punishable under Sections 409, 420, 465, 468, 471, 472, 120-B read with Section 34 of Indian Penal Code, subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (One lakh only) with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless - 6 - HC-KAR CNR: KAHC010565392026 NC: 2026:KHC:48278 CRL.P No. 12629 of 2026 exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co- operate with the police for investigation and appear before them whenever called upon. 4.
