NMD CRM (NDPS) 70 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bishnupur Police Station Case No. 121/2025 dated 05.02.2025 under Sections 21(c) of the NDPS Act, 1985; And In the matter of : Iman Ali Gayen @ Baccha ……Petitioner. Mr. Angshuman Chakraborty Mr. S.S. Saha ……for the Petitioner. Mr. Joydeep Biswas, Mr. Arup Sarkar ……for the State. Learned advocate appearing on behalf of the petitioner submits that petitioner has been falsely implicated in connection with the instant case for alleged recovery of 170 bottles of Phensedyl. Learned Advocate for the petitioner submits that the petitioner is in custody for more than eleven months. Charges have been framed. Petitioner be released on bail on any stringent condition. Learned Advocate appearing for the State opposes the prayer for bail and draws attention of the Court to the antecedent of the petitioner and submits that the petitioner is history-sheeter. The following cases are referred by the State:- 2 1. BSP P.S. Case No. 620, dated 02.12.2009, U/S 302/34 IPC & 25/27 Arms Act 2. BSP P.S. Case No. 345/2011, dated 02.04.2011, U/S 20(b) NDPS Act 3. Bishunupur P.S. Case No. 276/2024, dated 09.03.2024, U/S 25(i)(a)/35 Arms Act 4. Bishunupur P.S. Case No. 51/2025, dated 16.01.2025, U/S 25(i)(a)/27 Arms Act 5. Bishunupur P.S. Case No. 121/2025, dated 05.02.2025, U/S 21(C) NDPS Act. Having considered the antecedent of the present petitioner and the witness action is continuing, at this stage I am not inclined to release the petitioner on bail. However, petitioner has shown a document in respect of seizure which is disturbing, petitioner would be at liberty to approach after the evidence of seizure list witnesses are over. Learned Trial Court is directed to give priority for the examination of the seizure list witnesses. However, at this stage C.R.M. (NDPS) No 70 of 2026 is dismissed. The report submitted by SI of Police, O/C Bakhrahat Out Post, under Bishnupur P.S. DDH Police District be kept with the record. 3 All concerned parties shall act in terms of server copy of the order downloaded from the official website of this Court.
