Accused no. 5 in Crime No.231 of 2026 registered by Suryanagar Police Station, Bengaluru District for offences punishable under Sections 189(2), 191(2), 191(3), 190, 109, 352 & 351(2) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.231 of 2026 was registered by Suryanagar Police Station, Bengaluru District for the aforesaid offences against one Manu, Manja and others based on the first information dated 18.07.2026 received from Sri Shivakumar, son of late Nagaraj. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.5388 of 2026 before the - 3 - HC-KAR CNR: KAHC010553902026 NC: 2026:KHC:48337 CRL.P No. 12131 of 2026 jurisdictional Sessions Court, which was rejected on 31.07.2026. Therefore, he is before this Court. 4. A reading of the first information submitted on 18.07.2026 by Sri Shivakumar would reflect that he and accused no.2 - Manja had some ill-will. On 20.07.2026, when the first informant and his friends were tying some banners regarding birthday celebration, accused no.2 – Manja allegedly telephoned the first informant and asked his whereabouts. He subsequently informed the first informant that he would be coming to the said place. Thereafter, accused no.1 – Manu, accused no.2 - Manja and others came to the alleged spot, were the first informant and his friends were eating fish near a fish stall and after quarrelling with them, they allegedly mistook one Rakshith - injured victim to be the accomplice of the first informant and his friends and assaulted him with weapons, which they had brought. In the said incident, Rakshith, who had suffered grievous injuries was admitted to a hospital and thereafter, FIR was registered against accused no.1 - Manu, accused no.2 - Manja and others. - 4 - HC-KAR CNR: KAHC010553902026 NC: 2026:KHC:48337 CRL.P No. 12131 of 2026 5. During the course of investigation, accused no.2 - Manja was arrested and based on his confession statement, 7 persons are arrayed as accused nos.1 to 7. Petitioner is arrayed as accused no.5 in the remand application of accused no.2. Learned HCGP has brought to the notice of this Court that petitioner is a person with criminal antecedents and there are multiple criminal cases pending against him. 6. Considering the aforesaid aspects of the matter and also the fact that injured victim has suffered grievous injuries in the incident in question, I am of the opinion that the petitioner’s prayer for grant of anticipatory bail is to be rejected. 7.
