1 CGHC010347002026 2026:CGHC:43429 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8421 of 2026 1 - Ajay Kumar Yadu S/o Premu Yadu Aged About 28 Years R/o Village Ward No. 06, Tulsi Nevra, P.S. Tilda- Nevra, District- Raipur, (C.G.) ... Petitioner(s) versus 1 - State Of Chhattisgarh Through Station House Officer, Police Station Tilda- Nevra, Raipur, District- Raipur, (C.G.) ... Respondent(s) For Applicant : Shri C.R. Sahu, Advocate. For Non-applicant/State : Ms. Ritika Verma, P.L. HON’BLE SHRI JUSTICE RAKESH MOHAN PANDEY Order on Board 07/10/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.342/2026 registered at Police Station Tilda-Nevra, District Raipur (C.G.), for the offence punishable under Sections 303(2), 238 & 3(5) of BNS. NIRMALA RAO 2 2. The case of the prosecution, in brief, is that on 7.8.2026, an FIR was lodged by Sanjeev Tyagi with regard to the theft of his motorcycle on 5.8.2026 between 4:25 p.m. and 4:40 p.m. During the course of investigation, the present applicant was arrested and taken into custody on 7.8.2026. On the basis of the memorandum of the applicant, three more accused persons were arrayed as accused in the case. 3. Learned counsel for the applicant would submit that five stolen motorcycles were seized from the possession of co-accused persons, namely, Parmana Dewar, Ajit Jogi Dewar and Birbal Dewar. He would contend that the present applicant has been falsely implicated in the case. He would further submit that the charge-sheet has already been filed, the applicant has no criminal antecedents, he has been in jail since 7.8.2026, and the conclusion of the trial is likely to take some time. Thus, he would pray for grant of regular bail to the applicant. 4. On the other hand, learned counsel for the State would oppose the bail application and submit that the applicant and other co-accused persons were running a theft racket and that five motorcycles were seized from the possession of the present applicant. Therefore, the bail application deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the fact that five stolen motorcycles were seized from the possession of co-accused persons, namely, Parmana Dewar, Ajit Jogi Dewar and Birbal Dewar, that the applicant has no criminal antecedents, that the charge-sheet has already been filed, that the applicant has been in jail since 7.8.2026, and that the trial may take 3 some time to conclude, this Court is of the view that the applicant is entitled to be released on bail in the present case. Accordingly, the bail application is allowed. 7. Let the applicant be released on bail on his furnishing a personal bond in sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
