NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct respondent No.3 to consider its claim for - 3 - HC-KAR CNR: KAHC010594662026 NC: 2026:KHC:46679 WP No. 26890 of 2026 compensation in respect of the land bearing Sy.No.150/P32 situate Hulikunte Village, Doddabelavangala Hobli, Doddaballapura Taluk, Bengaluru Rural District measuring 06 acres, in view of a sale deed dated 07.04.2021 executed in its favour. It has also sought for a writ in the nature of mandamus to direct respondent No.3 to determine its entitlement to the compensation in respect of the aforesaid property and upon such determination to release/pay the compensation amount along with all statutory benefits. 2. The petitioner contends that it had purchased the aforesaid property in terms of a sale deed dated 07.04.2021 from Mr.Basavaraju. The aforesaid property was thereafter acquired by the respondent No.1 for the benefit of the respondent No.2 vide notification bearing No.¹L 36 J¸ï¦PÀÆå(E)2023 dated 20.02.2024 published in the official gazette dated 21.02.2024. It thereafter approached the respondent No.3 and submitted the sale deed executed in its favour to establish its right and also requested the respondent No.3 to pay the compensation. The petitioner contends that the - 4 - HC-KAR CNR: KAHC010594662026 NC: 2026:KHC:46679 WP No. 26890 of 2026 respondent No.3 has failed to consider its claim and release the compensation. The petitioner claims that on 12.08.2026, its representative visited the respondent No.3 and requested the respondent No.3 to disburse the compensation payable in respect of the aforesaid property. However, the respondent No.3 did not consider the same and therefore, the petitioner is before this Court seeking the aforementioned reliefs. 3. The learned Senior Counsel for the petitioner reiterated the above contentions and submitted that the petitioner being the lawful owner of the acquired property is entitled to claim the compensation. He contends that the name of the petitioner was not entered in the revenue records, though, it had purchased a property long prior to the notification issued by the respondent No.1 on 20.02.2024. He contends that it is incumbent upon the respondent No.3 to entertain the claim of the petitioner to ascertain whether the petitioner is entitled to receive the compensation and pass appropriate orders. He therefore submits that a direction be issued to respondent No.3 to consider the request of the - 5 - HC-KAR CNR: KAHC010594662026 NC: 2026:KHC:46679 WP No. 26890 of 2026 petitioner and pass appropriate orders regarding disbursal of the compensation in respect of the aforesaid land. 4. The learned counsel for the respondent Nos.2 and 3 submits that the acquisition was in the year 2024 and therefore, he is unaware whether the compensation is already released. He however contends that if the compensation is not released, the respondent No.3 would take steps to consider the request of the petitioner and pass appropriate orders. 5. In view of the above, the following order is passed: ORDER i. The writ petition is allowed; ii. The respondent No.3 is directed to consider the claim of the petitioner for compensation in respect of the acquisition of land bearing Sy.No.150/P32 of Hulikunte Village, Doddabelavangala Hobli, Doddaballapura Layout, Bengaluru Rural District, if not already released. - 6 - HC-KAR CNR: KAHC010594662026 NC: 2026:KHC:46679 WP No. 26890 of 2026 iii. This shall be complied within a period of three months from the date of receipt of a copy of this order.
