The applicant has preferred these First Bail Applications under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with several crimes registered at Police Station Kawardha, District : Kabirdham (C.G.), the particulars of which are detailed below: Case No. Crime No. Offence u/s MCRC/8901/2026 153/2026 Section 7 of Chhattisgarh Gambling (Prohibition) Act, 2022 MCRC/8938/2026 154/2026 MCRC/8946/2026 160/2026 2. According to the prosecution, on 14.04.2026, at the Raipur- Rajnandgaon Bypass, one Deepak Kashyap was apprehended by the police, who disclosed that he was connected with other persons, including the present applicant, and was engaged in online betting on IPL matches. On the same night, one Ankit Goswami was also apprehended by the police, he narrated a similar story and implicated the present applicant. Thereafter, on 23.04.2026, the police laid a trap and apprehended one Jitendra Jaiswal. During interrogation, he stated that the present applicant had provided the login ID that contained records relating to betting activities connected with IPL matches. The police recovered mobile phones and cash from the aforementioned individuals, registered several crimes simultaneously, and eventually arrested the present applicant on 15.07.2026. 3 3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in these cases on the basis of the memorandum statements of co-accused and mere suspicion of the police authorities. He further submits that the applicant has no criminal antecedents and the charge-sheet has already been filed in all these cases before the competent Court. He also submits that the applicant has been languishing in jail since 15.07.2026, and since the respective trials are likely to take some time to conclude, he prays for the grant of bail. 4. On the other hand, learned counsel for the State oppose the bail applications and submit that in the present cases, the charge- sheets have been filed before the competent Court and various articles were recovered from the possession of the co-accused persons, who implicated the present applicant in the commission of the aforementioned offence. Hence, he is not entitled to the grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. It appears that the applicant has been implicated in several crimes solely on the basis of the memorandum statements of the co-accused persons. Moreover, the present applicant has no previous criminal antecedents. Considering that the charge- sheets have already been filed before the competent Court in all 4 these cases, the applicant has been in jail since 15.07.2026, and the conclusion of the respective trials are likely to take some time, this Court is of the view that the applicant is entitled to be released on bail in these cases. 7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs. 50,000/- to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (a) he shall make himself available for interrogation by the police officer as and when required; (b)he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; and (c) he shall not act in any manner which will be prejudicial to a fair and expeditious trial. The observation made hereinabove is for the purpose of deciding these bail applications only, the learned trial Court shall decide the respective cases on their own merits.
