Saha … for the Petitioner(s) Mr. Bhaskar Prosad Banerjee Mr. Tapan Bhanja Mr. Gourab Karmakar … for the Air Customs Learned advocate for the petitioner submits that the petitioner has been implicated in this case on the alleged recovery of 7096 gm of ganja. The recovery was purportedly made at the Airport when the petitioner was returning from Bangkok. Learned advocate for the Air Customs Authority opposes the prayer for bail and submits that the complaint has already been submitted before the learned jurisdictional court. In view of the contention of the Hon’ble Supreme Court in [Barnali Bag –v- Union of India (Special Leave Petition 2 (Crl.) No. 3641 of 2026)], I am of the opinion that the petitioner may be released on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Yogendra Prasad shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 8th Court, Barasat. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of North 24 Parganas without prior permission of the learned Special court/trial court. Additionally, the petitioner shall make himself physically available as and when he will be called upon by the I.O. of the case as well as the Principal Commissioner of Airport, Air Customs. Accordingly, CRM (NDPS) 1916 of 2026 is allowed. Pending application(s), if any, is also disposed of.
