In this application the petitioners who are apprehending arrest have prayed for granting pre-arrest bail in a proceeding being Islampur Police Station Case No. 251 of 2026 dated 15.03.2026 presently pending before learned Additional Chief Judicial Magistrate, Islampur, Uttar Dinajpur.
Learned counsel appearing on behalf of the petitioners submits that initially petitioner no. 1 lodged a complaint before Islampur police station against the husband of the defacto complainant. As a counterblast, the defacto complainant has lodged this complaint against the petitioners with false and frivolous allegations. After making perfunctory investigation, investigating authority has submitted charge-sheet against the petitioners and the case is fixed for appearance of the petitioners and for charge hearing.

Learned counsel appearing on behalf of the State opposed the bail prayer. Having heard learned counsel for the petitioners and the State, it appears that the investigation has already culminated into a charge-sheet. I find that there is no prayer for custodial interrogation of the petitioners at this stage and as such the prayer for pre-arrest bail of the petitioners is allowed. Accordingly, I direct that, in the event of arrest, the petitioners, namely, Dipak Kumar Mahato @ Dipak Kr. Mahato and Dipankar Das, be released on bail upon furnishing a bond of Rs. 10,000/- each, with two registered surities of Rs. 5,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Islampur, Uttar Dinajpur, and also subject to the other conditions as laid down under section 482(2) of the BNSS, 2023.
Accordingly, C.R.M. (A) 989 of 2026 stands
disposed of.
