03.09.2026 Serial no. 75 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1903 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Kumarganj PS Case case no. 261 of 2024 dated 02.09.2024 u/s 21(c)/22(c)/23(c)/25/27A/28 of the NDPS Act. -And- In the matter of : Mahabur Mondal … Petitioner(s) Mr. Imtiaz Ahmed Ms. G. Firdaus Md. Arsalan Md. Bani Israil … for the Petitioner(s) Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick … for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of recovery in the present case is 1995 bottles of phensedyl from a vehicle which was lying in an abandoned place and the said vehicle was found in the name of the second wife of the present petitioner. So far as the present petitioner is concerned, learned advocate claims that he is innocent and has been falsely implicated in connection with the instant case. State has submitted Memo of Evidence which reflects that there are three criminal cases pending against the present petitioner under the provisions of the NDPS Act. 2 Learned advocate for the petitioner again submits that the petitioner was similarly tagged without any substantial recovery. Be that as it may, having regard to the antecedents of the present petitioner, I am of the opinion that this is not a fit case for granting bail to the present petitioner at this stage. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1903 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.) 3
