This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Sr. Div.) at Basirhat to dispose of the application dated December 10, 2025 praying for appointment of an advocate commissioner to hold local investigation. The learned advocate appearing for the petitioners submits that the said application is otherwise ready for hearing and is pending from the year 2025. From the order sheets appended to this application, this Court finds that the hearing of the application dated December 10, 2025 is fixed on December 11, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2950 of 2026 stands

disposed of by requesting the learned Civil Judge (Sr. Div.) at Basirhat to take up the hearing of the petition dated December 10, 2025 on the next date fixed i.e. on December 11, 2026, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the said application as well as any other interlocutory applications, that may be pending, the learned trial judge shall make an endeavour to dispose of the suit as expeditiously as possible. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
