Order on Board 06/10/2026
1. Applicant has preferred second bail application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he apprehends his arrest in connection with Crime No. 182/2025 registered at Police Station- Pasan (outpost Korbi), District Korba (C.G.) for offence punishable under Sections 318(4), 338, 336(3), 340(2) and 3(5) of BNS, 2023. The first bail RAVI SHANKAR MANDAVI Digitally signed by RAVI SHANKAR MANDAVI
2 application was withdrawn by the counsel representing the applicant on 11.09.2026 in MCRC(A) No.1471/2026 on the ground that applicant will file regular bail application before the concerned Court and has sought a direction for considering the said bail application to be filed on the same day. Learned counsel for the applicant submits that the applicant has filed second application to obtain the order on merits. In such submission made by the counsel for the applicant, this Court considered this second anticipatory bail application on merits. 2. Case of the prosecution, in brief, is that the applicant is brother-in- law of co-accused Jitendra Bhave (Patwari) and is involved in making arrangement of meetings of persons with his brother-in- law to mutate the government land in their favour and also to record the same in revenue records Online. FIR was lodged on the written report lodged by the complainant/Suman Das Manikpuri, Naib Tahsildar in which the applicant is apprehending. 3. Learned counsel for the applicant submits that there is no role of the applicant of either in recording the government land in the name of the co-accused Shiv Charan Mahra and Ajay Yadav or further making entry of the said land in the name of the said beneficiaries on Bhuiyan software i.e. the Online revenue record maintained by the department. The applicant was falsely implicated in the crime in question.
Hence, he may be enlarged on anticipatory bail. 3
4. Learned State counsel opposes the submission of learned counsel for applicant and would submit that according to the report there is active participation of applicant as he contacted the beneficiaries and thereafter has made arrangement of the meetings with his brother-in-law who is Patwari. He also submits that there are 3 criminal antecedents bearing Crime Nos. 113/2022, 71/2022 and 181/2025 against the applicant and all the crimes of are similar nature, therefore, applicant is not entitled for the benefit of the anticipatory bail. 5. I have heard learned counsel for the respective parties and also perused the documents enclosed along with bail application. 6. Considering entirety of the facts and circumstances of the case, submission of learned counsel for the respective parties, nature of allegation and further considering that there are 3 criminal antecedents against the applicant of similar nature, I do not find present to be a fit case to extend the benefit of anticipatory bail to the applicant. 7. Accordingly, this application filed under Section 482 of the BNSS, 2023 stands dismissed. Sd/-
