The petitioner, who is a practising advocate in the learned Sub-Divisional Court at Contai, applied for appointment as a notary pursuant to an advertisement dated September 16,
2020. Subsequently, the names of the candidates recommended were published and the petitioner was one of them. By a memo dated February 21, 2024, the Law Officer, Department of Law, Government of West Bengal directed the petitioner to appear before the officials of the said department on March 28, 2024 with all original documents as mentioned in From-1 of the Notaries Rules, 1956 for verification. 2. According to the petitioner, he duly appeared before the department and submitted all the original documents as mentioned in the memo dated February 21, 2024. Subsequently, the Law Officer of the said department directed the petitioner to deposit a sum of Rs.2,000/- for issuance of the certificate of practice. Such payment was made by the petitioner on June 27, 2024. Thereafter, the Law
2 Officer of the said department directed him to submit the original certificate issued by the Bar Council, West Bengal. By a forwarding letter dated November 3, 2024, the petitioner submitted the certificate issued by the Bar Council of West Bengal. Thereafter, on January 24, 2025 he again submitted the said certificate before the Law Officer, Law Department, Government of West Bengal. Since nothing fruitful happened, the petitioner made a representation dated August 26, 2025 to the respondents. 3. The petitioner, by filing this writ petition, has alleged inaction on the part of the respondents in not considering his representation dated August 26, 2025 and in not appointing him as a notary pursuant to the said advertisement. 4. Heard the parties. 5. It appears that the issue of the petitioner’s appointment as a notary has been kept pending by the respondents for a considerable period of time. Therefore, no useful purpose will be served by keeping this matter pending. 6.
Accordingly, I direct the respondent no.2 to consider the representation dated August 26, 2025 by extending an opportunity of hearing to the petitioner and pass a reasoned order within a period of six weeks from the date of communication of this order, in accordance with law. 3

If it is found that the petitioner is eligible to be appointed as a notary pursuant to the said advertisement, the concerned respondent is directed to issue the letter of appointment within a period of two weeks from the date of passing of the reasoned order. 8. Accordingly, the writ petition stands disposed of. 9. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
