ORAL ORDER
1. Petitioners are before this Court being aggrieved by the issuance of final notices dated 06.03.2024 as per Annexures-G and H, in terms of which, petitioners have been called upon to pay user charges in a sum of Rs.36,08,532/- and Rs.8,00,725/- respectively.
2. Learned counsel for the respondents, at this juncture submits that in an identical matter, this Court had
disposed of the petition, reserving liberty to the petitioner therein to file statement of objections with a direction to the respondent No.3-Marketing Committee to pass appropriate order.
3. Learned counsel for the petitioners does not dispute the same and submits that, if such an order is passed purpose of the petition would be served.
4. This Court in W.P.No.17518/2024, under identical circumstances has passed the following:
"5. Since the respondent authorities have not passed any orders and have merely issued a final notice dated 12.06.2024 calling upon the petitioner to pay the user fee as mentioned therein, it is open for the petitioner to raise all

such contentions as may be available under law together with production of documents as requisitioned in this regard.
6. The petitioner is at liberty to file statement of objections, if not filed already filed and respondent No.3 shall pass appropriate orders thereon within an outer limit of eight weeks from the date of receipt of certified copy of this
order. No coercive or prohibitive steps shall be taken by the respondents until passing of the order as directed herein above.
Writ petition is disposed of accordingly."
5. Since the present petition is also similarly situated, petition is disposed of, in terms of the aforesaid order.
6. The petitioners are at liberty to file statement of objections, if not already filed and respondent No.3- Marketing Committee shall consider all the contentions that will be urged by the petitioners and pass appropriate
order.
