Accused No.1 in SC No.5021/2025 pending before the Court of VIII Additional District and Sessions Judge, Mysuru, sitting at Hunsur, arising out of Crime No.118/2025 registered by Bilikere Police Station, Mysuru, for the offence punishable under Section 103(1) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.118/2025 was registered by Bilikere Police Station, Mysuru, for the aforesaid offence against petitioner and another based on the first information dated 04.04.2025 received from Poojashree B, police officer attached to Bilikere Police Station. During the course of investigation, petitioner was arrested on 04.04.2025 and subsequently, remanded to judicial custody. After completing investigation, charge sheet is filed against two persons and petitioner is arraigned as accused No.1 in the charge sheet. His bail - 3 - HC-KAR CNR: KAHC010560862026 NC: 2026:KHC:48169 CRL.P No. 12268 of 2026 application filed before the Trial Court in SC No.5021/2025 was rejected on 25.07.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that accused No.1 and deceased Pavithra, who were in love subsequently, got married in Mahadeshwara Temple at Halebid Village, Hunsur Taluk and started living in the house of accused No.1. Pavithra subsequently informed the petitioner that she intends to go for work. Petitioner allegedly enquired with CW30 with whom Pavithra was allegedly working. CW30 had informed petitioner that Pavithra was not working with him. Thereafter, petitioner had contacted CW2, who was a common friend of the petitioner and his wife. CW2 allegedly informed petitioner that Pavithra's character was not good and he had forwarded certain photographs and videos in which Pavithra was found dancing in a pub. It is under these circumstances, accused No.1 and his friend accused No.2 conspired to commit the murder of Pavithra and in furtherance of such conspiracy, on 04.04.2025, petitioner had taken his wife Pavithra along with him to their agricultural field and thereafter, accused Nos.1 and 2 had - 4 - HC-KAR CNR: KAHC010560862026 NC: 2026:KHC:48169 CRL.P No. 12268 of 2026 strangulated the neck of Pavithra with the help of plastic rope and committed her murder. 5. The entire case of the prosecution is based on circumstantial evidence. Accused No.2 as against whom similar allegations are found in the charge sheet is said to have been granted regular bail by the jurisdictional Sessions Court. It is not in dispute that the petitioner has no other criminal antecedents. Trial in the case is yet to commence. Under the circumstances, the following order:- 6. The criminal petition is allowed. The petitioner is directed to be enlarged on bail in SC No.5021/2025 pending before the Court of VIII Additional District and Sessions Judge, Mysuru, sitting at Hunsur, arising out of Crime No.118/2025 registered by Bilikere Police Station, Mysuru, for the offence punishable under Section 103(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010560862026 NC: 2026:KHC:48169 CRL.P No. 12268 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
