JUSTICE JAYANT BANERJI) A compliance affidavit has been filed today by the Accused No.2 / Manjunatha K, presently serving as Tahsildar, Koratagere Taluk, who is present in Court. Paragraph Nos.8 and 9 of the said compliance affidavit reads as follows: “8. It is respectfully submitted that without demarcation of the entire extent of 180 acres of Deemed Forest Area, we are unable to obtain NOC from the Forest Department for taking further action regarding change of khata as per saguvalichit, issued to the complainant. The application of the complainant has been considered and an endorsement dated 28.08.2026 has been issued by me. The copy of the said endorsement is now being furnished to the complainant as a part of this affidavit. The copy of the said - 3 - HC-KAR CNR: KAHC010519502026 NC: 2026:KHC:46924-DB CCC No. 945 of 2026 endorsement dated 28.08.2026 is herewith produced as ANNEXURE-R3. The copy of the said endorsement has also been sent to the complainant through registered post acknowledgement on 28.08.2026. The copy of the said acknowledgement is herewith produced as ANNEXURE-R4. 9. It is submitted that earlier to the communication dated 20.12.2022 (produced at Annexure R1 herewith), several grantees who had been granted land in the said Survey No.24 of Obanahalli Village, C.N. Durga Hobli, Koratagere Taluk, had been issued with Khata and Pahani as in 1999 – 2000, 2004-2005 till 2018 -2019. It is only after the receipt of the communication produced at Annexure R1, we are seeking NOC from the Forest Department as we are awaiting for no objection from the Forest Department to consider applications for issue of Khatha and Pahani with respect to land in Survey No.24, Obanahalli village, Koratagere Taluk.” 2. We have perused the endorsement that is enclosed as Annexure-“R3” which is dated 28.08.2026. The endorsement reads as follows: “ENDORSEMENT Subject: Regarding the request for making Khata and Pahani in accordance with the order of the Hon'ble High Court. Reference: 1. Representation submitted by Sri Ranganna, S/o Late Bomanna, dated 18.07.2022 and received on 27.07.2022. 2. Letter of the Range Forest Officer, No. Sa.Vu.207/2022-23, dated 21.12.2022. - 4 - HC-KAR CNR: KAHC010519502026 NC: 2026:KHC:46924-DB CCC No. 945 of 2026 3. Letter of this office No. RUC/C.N. Durga/378/22- 23, dated 19.12.2025. With reference to the subject, with regard to 2 acres 30 guntas of land in Sy. No. 24 of Obanahalli Village, C.N. Durga Hobli, Koratagere Taluk, the land was granted under RUC/C.N. Durga/278/91-92 and a Saguvali Chit (Certificate of Grant) was issued. A representation was submitted as per Reference No. 1 requesting that Khata and Pahani be made. The Hon'ble High Court, in W.P. No. 1319/2023, has ordered that the petitioner's request regarding making the Khata entry be considered in accordance with law. Accordingly, you have requested that Khata and Pahani be made. Upon examination of the matter, it is found that Sy. No. 24 of Obanahalli Village, C.N. Durga Hobli, Koratagere Taluk, has a total extent of 336.07 acres, out of which an extent of 180 acres has been included as deemed forest under FEE.185.FAP.2011 dated 15.05.2014. Out of the said 180 acres of deemed forest area, a survey/measurement has already been conducted and an extent of 159.08 acres has been identified for the Forest Department and a map has been prepared. The remaining 20 acres 32 guntas is required to be identified by conducting a joint survey/measurement once again. The Forest Department has submitted a report as per Reference No. 2 stating that the entire 180 acres of deemed forest area in the proposed Survey Number should be identified on the spot and reserved for the Forest Department, and that no grant should be made in the said area. It has further been stated that, excluding the deemed forest area, necessary action may be taken in accordance with the rules in respect of the remaining area. - 5 - HC-KAR CNR: KAHC010519502026 NC: 2026:KHC:46924-DB CCC No. 945 of 2026 Therefore, as per Reference No. 3, a memorandum was issued for conducting the joint measurement. Since the joint measurement by the Forest, Revenue and Land Survey Departments, along with joint spot inspection, for identifying the remaining 20 acres 32 guntas of deemed forest area is still pending, your request cannot be considered. In view of the aforegoing, we find that due compliance of the order of the writ court has been made. 4. This contempt petition is consigned.
