1) Matter is taken up for consideration when learned advocate representing petitioner prays for direction upon concerned police authorities to take steps based on advocate’s letter dated 30th July, 2026 and initiate investigation. According to petitioner, there is inaction on the part of police authorities to take steps in spite of receipt of said letter dated 30th July, 2026. 2) However, communication dated 27th August, 2026 of Inspector-in-Charge, Gazole Police Station, Malda which is filed today by learned advocate representing State respondents reveals different story. A complaint has been lodged against petitioner by one, Shri Nishad Saha on 19th August, 2026 being genesis of FIR being Gazole Police Station Case No. 1025/2026 dated 19th August,
2026.
According to concerned police authorities, petitioner promised to supply furniture/ electrical appliances at discounted price to local persons and thereafter petitioner went missing.
2 Communication dated 27th August, 2026 is taken on record. 3) Allegation made against petitioner is disputed by learned advocate for the petitioner. 4) Having seen contents of communication dated 27th August, 2026, it appears that present writ petition is filed by petitioner in order to obtain an order from this Court to protect himself from impending criminal prosecution. 5) Hence, present writ petition stands dismissed. 6) However, this order shall not preclude concerned police authorities to conclude investigation in Gazole Police Station Case No. 1025/2026 dated 19th August, 2026 in accordance with law and to submit report expeditiously before jurisdictional Magistrate. 7) Parties to act on server copy of this order duly downloaded from the official website of this Court.
