1. Heard on admission. 2. This appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the appellant/claimant challenging the award dated 15.07.2026 passed by learned Motor Accident Claims Tribunal, District Korba (CG) in Motor Accident Claim Case No.25/2025, whereby the Tribunal has awarded a total compensation of Rs. 36,120/- on account of the injuries sustained SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.10.07 16:52:30 +0530
2 by the Appellant in a motor vehicle accident that occurred on
03.08.2024. 3. The learned Tribunal, after considering the evidence and documents brought on record, held that the appellant had sustained simple injuries to his right leg and right hand in the accident. However, no permanent disability or grievous injury was found to have been suffered by the appellant. Accordingly, the learned Tribunal awarded compensation under the following heads: S.No. Compensation awarded by the Tribunal Amount
1. Medical expenses Rs.10,000/-
2. Physical and mental pain, special diet and nutrition, and transportation expenses Rs.10,000/- (lump sum)
3. Loss of income for two months Rs.16,120/- Total Rs.36,120/-
4. Learned counsel appearing for the appellant submits that the appellant was working as a motorcycle mechanic in his own garage and was earning Rs.50,000/- per month.
However, the Tribunal has erred in not accepting the said claim and, while assessing the income of the appellant, has assessed the same at Rs.16,120/- for two months by treating him as an unskilled labourer. He further submits that the appellant had produced medical bills (Ex.A/19 to A/43) amounting to Rs.37,557/-, but the Tribunal has erroneously awarded only Rs.10,000/- towards the said medical expenses. He, therefore, submits that the compensation awarded by the Tribunal deserves to be suitably enhanced. 5. Heard learned counsel for the appellant and perused the record with due care and circumspection. 6. In the case at hand, it is evident from the material available on record that the appellant/injured had sustained simple injuries in the accident and had undergone treatment at Government Hospital, Korba, under the Ayushman Bharat Scheme through his Ayushman Card. There is no receipt, bill, or other cogent evidence
3 on record to establish that the appellant/injured had incurred any substantial expenditure towards his treatment. Further, considering the nature of the injuries sustained by him, which were simple in nature, this Court is of the considered view that the compensation awarded by the learned Tribunal is just, fair, and reasonable and does not warrant any interference. 7. Consequently, finding no merit in the present appeal, the same is hereby dismissed at the admission stage. 8. No order as to costs. Sd/- (Sanjay Kumar Jaiswal) Judge $ourabh
