JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court seeking the following prayers: "WHEREFORE, it is most humbly and respectfully prayed that this Hon'ble Court may be pleased to: a) Quash the FIR dated 15.06.2026 registered by the 1st Respondent in Crime No. 179/2026 under Sections 115(2), 118(1), 126(2), 329(4), 351(3), 352 R/W Sec 3 (5) of the Bharatiya Nyaya Sanhita, 2023 at Annexure - A; b) Quash the Complaint dated 14.06.2026 filed by the 2nd Respondent in Crime No. 179/2026 for offences punishable under Sections 115(2), 118(1), 126(2), 329(4), 351(3), 352 R/W Sec 3(5) of the Bharatiya Nyaya Sanhita, 2023 at Annexure - B; c) Pass any such orders as this Hon'ble Court deems fit, in the interest of justice." 2. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Memorandum of Settlement in that regard, which reads as follows: “JOINT MEMORANDUM OF SETTLEMENT It respectfully submits as under: 1. The Petitioners and the 2nd Respondent have known each other for around 2 years and have been friends. A misunderstanding between them led to scuffle which resulted in the 2nd Respondent filing a complaint against the Petitioners and the subsequent registration of the First Information Report. The Petitioners and the 2nd Respondent have amicably resolved their dispute. The Petitioners have tendered their apologies to the 2nd Respondent for their actions, and the 2nd Respondent has accepted the apologies and has stated that he longer wishes to pursue the complaint. Hence the petition has been filed to quash the complaint and the FIR in light of the settlement. 2. The Petitioners have tendered their apology to the 2nd Respondent for the scuffle that broke out between them and the 2nd Respondent. The 2nd Respondent has accepted their apologies and does not wish to pursue the criminal complaint filed against the Petitioners pursuant to which FIR has been registered in crime no Crime No. 179/2026 under Sections 115(2), 118(1), 126(2), 329(4), 351(3), 352 R/W Sec 3 (5) of the BNS. In the light of Joint Memorandum of Settlement being filed and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioners in the subject petition. 6.
