District & Sessions Judge, Srikakulam and permit the Petitioners/Accused No.2, 3 to deposit the surety bond amount of Rs.10,000/- with single surety each instead of Rs.25,000/- with two sureties each and pass Counsel for the Petitioner/accused(S): 1. PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 439(1)(b) of the Code of Criminal Procedure, 1973 (for brevity „the Cr.P.C.,‟)/Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity „the BNSS‟), seeking to modify the condition imposed on the petitioner/Accused Nos.2 and 3vide order dated 17.02.2026 in Crl.M.P.No.200 of 2026 in Crime No.03 of 2026 of Ichapuram Police Station, passed by the learned I Additional District and Sessions Judge, Srikakulam. 2. The learned counsel for the petitioners submits that the financial condition of the petitioners is deplorable and he is unable to comply with the conditions imposed by the learned Trial Court. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 4. Considering the above facts and circumstances of the case, theorder order dated 17.02.2026 in Crl.M.P.No.200 of 2026 in Crime No.03 of 2026 of Itchapuram Police Station, passed by the learned I Additional District and Sessions Judge, Srikakulam, against the petitioners/Accused Nos.2 and 3 is hereby modified as under: i. The Petitioners/Accused Nos.2 and 3shall be enlarged on bail subject to their executing a bond for a sum of Rs.15,000/- (Rupees Fifteen thousand only) with two sureties for the like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Ichapuram. 5. The residual conditions imposed by the learned Trial Court, in the original order shall remain in force and shall be duly complied with by the Petitioner/Accused Nos.2 and 3. 6.
