1. The petitioner has filed the first petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail to him in case FIR No.182, dated 05.07.2026, registered under Section 21 of N.D.P.S Act and 111 of B.N.S., 2023 (lateron added Section 29/61/85 of N.D.P.S Act) at Police Station Dharamkot, District Moga, Punjab (Annexure P-1).
2.
Learned counsel for the petitioner contends that on the basis of a secret information, Gurjeet Singh @ Peehli, co-accused was arrested by the police and 01 Kg of heroin was recovered from him, without any permit or license. Learned counsel further submits that Gurjeet Singh @ Peehli, co- accused had suffered a disclosure statement in police custody and on the basis of said disclosure statement, the petitioner was also nominated as an accused in the present case. After his arrest on 06.07.2026, no recovery was effected from HITESH 2026.09.10 16:20 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CRM-M-50063-2026 -2 the petitioner. He further submits that in the present case, the investigation is almost complete and further custody of the petitioner will not serve any meaningful purpose. He further submits that the petitioner has clean antecedents and was never involved in any other criminal activity.
3. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner, however, he admits that the petitioner is not involved in any other crime.
4. I have heard the learned counsel for the parties and perused the record carefully.
5. In the present case, admittedly, the recovery was effected from Gurjeet Singh @ Peehli, co-accused and he has already been arrested by the police in the present case. However, the case of the petitioner is clearly distinguishable from the case of his co-accused Gurjeet Singh @ Peehli and no recovery was effected from him. Thus, further custody of the petitioner will not serve any meaningful purpose.
6. Without commenting on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on bail pending trial on his furnishing bail bonds and surety to the satisfaction of the concerned trial Court/ Duty Magistrate/Chief Judicial Magistrate.
