Since common questions of law and facts are involved in these batch of petitions, therefore, they are clubbed together, heard together and are being disposed of by this common order. 2. The petitioners/institutions have filed these petitions challenging the orders/recommendations dated 18.02.2014, 01.07.2015 and 24.04.2010, whereby the Admission and Fee Regulatory Committee, State of Chhattisgarh, has directed the petitioners to refund the fees collected from the private respondents/students on account of cancellation of their admission. Order/recommendation dated 24.04.2010 was passed on the basis of the order dated 19.03.2010 issued by the Additional Secretary, Technical Education, Manpower Planning, Science and Technology, Raipur, which is also under challenge. 3. The grievance of the petitioners/institution is that the students who had taken admission in technical institutions and had sought cancellation of their admission after the last date of admission could not be permitted to claim refund of the fees paid by them. 4. Learned counsel appearing for respective petitioners/institution would submit that after expiry of last date of admission and completion of first or second semester, the institution was not in a position to fill the vacant seat. Consequently, the seat remained 19 vacant not only for the concerned semester but for the entire duration of the course, which could be three, four or five years. They would further submit that the institution suffered loss of fees for the entire duration of the course. They would submit that the order/recommendation passed by the committee is bad in law, whereby the committee directed the petition/institution to refund the fees paid for the concerned semester. Ms. Dangi would submit that the transportation fees, caution money of the students have already been refunded and transfer certificates were also provided to the concerned students. 5. They further submits that the issue involved in these petitions is no more res integra and is squarely covered with the judgment passed by the Hon’ble Division Bench passed in the matter of Disha Education Society vs. State of Chhattisgarh and other connected matter in W.P.(C) No. 2112/2010. 6. On the other hand, learned counsel appearing for the respective respondents would oppose the submissions advanced by the petitioners/institutions. They would submit that the petitioners/institutions are bound to comply with the orders passed by the Committee and the students are entitled for refund of fees paid by them. They would further submit that merely because the students sought cancellation of their admission after the last date of admission, the petitioners/institutions cannot deny the refund of fees as directed by the Committee. They would contend that these petitions deserves to be dismissed. 20 7. I have heard learned counsel for the parties and perused the documents placed on record. 8. It is not in dispute that the question involved in these petitions is squarely covered with the judgment passed by the Hon’ble Division Bench in the matter of Disha Education Society (supra). The Hon’ble Division Bench while dealing with the similar issue held as under:- "39. The next question is whether the directions issued by the Committee in Para 35 of its report with regard to refund of the fee to such candidates, who withdraw from the institution in the midstream, are contrary to the law laid down by the Supreme Court in Islamic Academy? 40. The Committee has directed that where a student withdraws from the institution before starting of the course, the institution can deduct not more than Rs. 1,000/- from the fees deposited and rest of the amount should be refunded to the candidates. Where the candidate withdraws from the institution in the midstream, proportionate deductions of monthly fees and other charges, like hostel fees, transportation charges etc.. shall be made and remaining amount should be refunded and returned. The above refund is to be made within a fortnight else the student shall be entitled for refund along with interest @ 10% per annum. It has been further directed that in no circumstance, the original testimonials should be obtained from a candidate seeking admission. Where a student leaves the institution, the institution should issue Institution Leaving Certificate and deliver the same to the 21 student immediately. Any violation of the above directions shall call for punitive action in accordance with provisions contained in the Act. 41. Learned counsel for the petitioners vehemently argued that the aforesaid directions are contrary to the directions issued by Supreme Court Islamic Academy. If the student leaves the institution in midstream, the seat occupied by such student remains vacant for the entire session which results in huge loss to the institution. This aspect has not been considered by the Committee while issuing directions, as mentioned above. 42. The above argument was considered by the Supreme Court in para-8 of the Islamic Academy, which is reproduced as under:- "8. It must be mentioned that during arguments it was pointed out to us that some educational institutions are collecting, in advance, the fees for the entire course i.e. for all the years. It was submitted that this was done because the institute was not sure whether the student would leave the institute midstream. It was submitted that if the student left the course in midstream then for the remaining years the seat would lie vacant and the institute would suffer. In our view an educational institution can only charge prescribed fees for one semester/year. If an institution feels that any particular student may leave in midstream then, at the highest, it may require that student to give a bond/bank guarantee that the balance fee for the whole course would be received by the institute even if the student left in midstream. If any educational institution has 22 collected fees in advance, only the fees of that semester/year can be used by the institution. The balance fees must be kept invested in fixed deposits in a nationalized bank. As and when fees fall due for a semester/year only the fees falling due for that semester/year can be withdrawn by the institution. The rest must continue to remain deposited till such time that they fall due. At the end of the course the interest earned on these deposits must be paid to the student from whom the fees were collected in advance." Considering the above observations, we are of the opinion that the Committee was not justified in issuing such blanket directions, as mentioned in para 35 of its report, and the procedure mentioned in the judgment of the Supreme Court should have been followed. 43. On the basis of aforesaid discussions, we dispose of these petitions in the following terms: (I) that Sections 4(1), 4(8), 9, 12 and 13 of the Act, 2008 are intra vires and constitutional as the same do not Interfere with the petitioners' fundamental right to establish and administer an educational institution in the matters of fixation of fee to be charged from the students; (ii) fixing of upper cap limit of Rs.10,000/- per semester towards mess, transport and hostel charges is irrational and impermissible, and the same is, accordingly, set aside. However, all the institutions have to provide the above facilities on "No Loss, No Profit" basis as per actual expenditure incurred in providing such facilities; (iii) the directions contained in para 35 of the report of the Committee, being not in accordance with the observations in para 8 of the Islamic Academy, are 23 hereby set aside and in place thereof, we issue directions as under: (a) that, the educational institutions can charge only prescribed fee for one semester If an institution feels that any particular student may leave in midstream then, it may require that student to give a bond/bank guarantee that the balance fee for the whole course would be received by the institute even if the student left in midstream. (b) that if any educational institution has collected fees in advance, only the fees of that semester/year can be used by the institution. The balance fees must be kept invested in fixed deposits in a nationalized bank. As and when fees fall due for a semester/year only the fees falling due for that semester/year can be withdrawn by the institution. The rest must continue to remain deposited till such time that they fall due. At the end of the course the interest earned on these deposits must be paid to the student from whom the fees were collected in advance. 9. It would be highly unjust on the technical institutions if they are asked to refund fees of even one semester which they have charged in those cases where the students seek cancellation of the admission at such a late stage that the institution cannot fill up the vacant seat. There are two ill affects. Firstly, a valuable seat in a technical institution remains vacant which causes loss to society at large. Secondly, the technical institution cannot get any fees for that seat for the remaining semesters which may be 5, 7 or 9 depending on the nature of the course. It is already loosing fees for these semesters and therefore, it would be highly unjust to ask the 24 technical institution to refund fees for that one semester where the student delays cancellation. 10. Where students seek cancellation of their seat during the first semester, they must seek cancellation at least 5 days prior to the last date of filling of the seat so as to give reasonable time to the institution to fill up the same. In case the application for cancellation of admission is not made five days prior to the last date of admission, then the student shall not be entitled to any refund. 11.
