KAMAL - 3 - HC-KAR CNR: KAHC010424662023 NC: 2026:KHC:46674 WP No. 18363 of 2023 ORAL ORDER The petitioner claimed to have purchased 20 guntas of land in Sy.No.41 (old Sy.No.40) situated at Bellahalli Village, Yelahanka Hobli, Bengaluru North Taluk in terms of Deed of Sale dated 09.12.2021; that he had paid registration charges and other miscellaneous charges in a sum of Rs.36,160/- and the stamp duty of Rs.1,98,050/-. However, respondent No.4-Sub Registrar has kept the registration pending demanding additional stamp duty and registration charges; that despite repeated requests by the petitioner of he being ready and willing to pay the additional stamp duty and the registration fee if any, respondent No.4 has not responded. Therefore, the petitioner is constrained to approach this court. 2. Learned AGA submits that, if the petitioner approaches the concerned Sub-Registrar, by paying additional stamp duty and charges, if any, to be determined, his request would be considered expeditiously. - 4 - HC-KAR CNR: KAHC010424662023 NC: 2026:KHC:46674 WP No. 18363 of 2023 3. Heard both sides and perused the records. 4. Petitioner at paragraph No.7 (grounds) of the writ petition has pleaded as under : "7. Under Section 45(A-1) the stamp duty and registration charge shall be assessed as per the market value, as on date of the presentation of the document. The petitioner has paid stamp duty of Rs.1,98,050/- and registration charges Rs.31,160/- if any remaining insufficient, the petitioner is ready to pay the charges as per the Karnataka Stamp Act. But the 3rd respondent has kept pending from 2021 to till today is illegal and contrary to the Act." Thus the petitioner has expressed his readiness and willingness to pay the remaining insufficient stamp duty and registration charges, if any. 5. In that view of the matter, the following order is passed : ORDER i) Writ petition is allowed; - 5 - HC-KAR CNR: KAHC010424662023 NC: 2026:KHC:46674 WP No. 18363 of 2023 ii) The petitioner is at liberty to submit a representation before respondent No.4 within 30 days from the date of receipt of the certified copy of this order. iii) Upon such representation, respondent No.3 shall determine the stamp duty and registration fee payable, if any, on the instrument referred to and shall proceed to complete the process of registration and release the document, as expeditiously as possible, within an outer limit of 30 days thereafter.
