1. The present revision petition has been filed by the petitioner/appellant for setting aside the order dated 18.08.2026 (Annexure P-1) passed by the Lower Appellate Court, whereby the application filed by the petitioner/appellant under Order XXXIX Rule 2A of the Code of Civil Procedure, 1908 (for short, ‘CPC’) has been adjourned to 27.11.2026.
2. A perusal of the facts of the present case would show that the petitioner/appellant had filed a suit for declaration and mandatory injunction. The said suit was dismissed by the Trial Court vide
judgment and decree dated 02.04.2024. Aggrieved against the said
judgment and decree dated 02.04.2024, the petitioner/appellant preferred an appeal before the Lower Appellate Court. During the pendency of the said appeal, the petitioner/appellant also filed an application under Order XXXIX Rule 2A CPC, which has been adjourned to 27.11.2026. -1- DIWAKER GULATI 2026.09.11 14:56 I attest to the accuracy and integrity of this document

3. The limited prayer made by the petitioner/appellant is that a direction may be issued to the Lower Appellate Court to decide the appeal as well as the application under Order XXXIX Rule 2A CPC, in a time-bound manner.
4. Taking into consideration the nature of the prayer made by the petitioner/appellant, it is not necessary to issue notice to the respondents.
5. Without expressing any opinion on the merits of the case and in view of the limited prayer made by the petitioner/appellant, the present revision petition is disposed of with a request to the Lower Appellate Court to make every endeavour to decide the appeal as well as the application under Order XXXIX Rule 2A CPC filed by the petitioner/appellant, as expeditiously as possible, in accordance with law.
