JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court seeking the following prayers: "Wherefore, it is prayed that this Hon'ble court be pleased to, a. After perusing the records Quash the Charge sheet in C.C.No.23588/2026 by the Commercial Street Police, Bengaluru for the alleged offences punishable under section 316(3), 316(5), 318(4) R./w 3(5) of BNS, 2023, - 3 - HC-KAR CNR: KAHC010593722026 NC: 2026:KHC:46394 CRL.P No. 13131 of 2026 before the IV Addl. Chief Judicial Magistrate, Bengaluru in the interest of justice and equity. b. And also such other and further relief's as this Hon'ble Court deems fit considering the facts and circumstances of the case to meet the ends of justice." 2. Heard Sri.Ananda K.V., learned counsel appearing for the petitioners, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1, Sri.Amit Deshpande, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “1. The 1st parties herein are the petitioners/Accused No.2 & 3 respectively in the above case and the 2nd party herein is Complaint/ Respondent No.2, they we both aware about the facts and circumstances of the case. The above named respondent No.2/ Defacto Complainant had lodged a complaint before the Commercial Street Police station against the accused No.2 & 3 / petitioners herein along with Accused No.1 forthwith the respondent police have filed a Charge Sheet in Connection with the FIR in Cr.No.54/2025 against the petitioners & another in C.C.No.23588/2026 for the alleged offences punishable under section 316(3), 316(5), 318(4) R/w 3(5) of BNS, - 4 - HC-KAR CNR: KAHC010593722026 NC: 2026:KHC:46394 CRL.P No. 13131 of 2026 2023, before the IV Addl. Chief Judicial Magistrate, Bengaluru. 4. It is submitted that due to the interventions of the well-wishers and Elders and considering the fact that accused/ Petitioners herein are Business Customers, the 2nd party/complainant herein agreed to with draw the complaint which is registered as FIR in Cr.No.54/2025 & also the Charge sheet filed against the Petitioners/accused No.2 & 3 in C.C.No.23588/2026 for the alleged offences punishable under section 316(3), 316(5), 318(4) R/w 3(5) of BNS, 2023, before the IV Addl. Chief Judicial Magistrate, Bengaluru, they agrees that they will not commit any other offence in future. Both the parties are filing this Joint Affidavit without any threat, coercion or undue influence and this compromise is arrived at voluntary basis. 5. Hence consider the Joint Affidavit and permit us to compound the offence by allowing the annexed application and consequently quash the Charge Sheet filed by the Commercial Street PS in C.C.No.23588/2026 for the alleged offences punishable under section 316(3), 316(5), 318(4) R/w 3(5) of BNS, 2023, which is before on the file of IV Addl. Chief Judicial Magistrate, Bengaluru, to meet the ends of Justice and equity. What is stated above are true and correct to the best of our knowledge, information and Belief.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the same and - 5 - HC-KAR CNR: KAHC010593722026 NC: 2026:KHC:46394 CRL.P No. 13131 of 2026 terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.23588/2026 pending before the IV Addl.
