Learned advocate for the State submits that there were recoveries of 47 bottles of codeine mixture and 131 bottles of Eskuf cough syrup near the border and the BSF personnel who lodged the information submitted that the petitioner was one of the persons who fled away from the spot at the time when the Central Forces intended to intercept and recover the contraband. 2 Learned advocate for the State additionally submits that CDR is also available so far as the present petitioner is concerned. Having considered that the petitioner fled away from the spot; the availability of the CDR and only charge-sheet has been submitted, at this stage, I am not inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1906 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
