Kausik (Rejected) CRM (M) 1774 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Falta Police Station Case No. 47 of 2025 dated 07.03.2025 under Section 85/103(1)/238 of the BNS, 2023. And In the matter of : Golam Ali Seikh @ Sekh ……Petitioner. Mr. Niladri Sekhar Ghosh Mr. Partha Sarathi Mondal ……for the Petitioner. Mr. Sayak Chakraborty Mr. Soumya Raha ….for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 6 months. So far as the issues on which the earlier bail applications were rejected, the same are easily rebuttable in view of the fact that the CCTV footage which has been relied upon by the prosecution do not portray the correct date. Additionally the body was recovered from a different place and unnecessarily the present petitioner has been foisted with a case. 2 State has opposed the prayer for bail and submits that FSL report do fortify the claim of the prosecution relating to the victim/deceased being burned to death by usage of petrol. Be that as it may, I have taken into account the heinousness of the offence and the incriminating materials appearing at this stage which are obviously subject to proof. Having considered the same, at this stage, I am not inclined to release the petitioner on bail. Petitioner will renew his prayer for bail after the evidence of the vulnerable witnesses are over. Accordingly, CRM (M) 1774 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
