JUSTICE B M SHYAM PRASAD - 3 - HC-KAR CNR: KAHC010072032026 NC: 2026:KHC:46229 CMP No. 50 of 2026 ORAL ORDER The petition is for the appointment of a sole arbitrator to enter reference of the dispute between the petitioner and the respondent. Ms. Archana K M, the learned counsel for the petitioner, submits that the petitioner’s claim against the respondent arises out of a Consultancy Agreement dated 04.10.2023 [Annexure – A] and the allegation of breach of the terms by the respondent. Ms. Rithika Ravikumar, the learned counsel for the respondent, without disputing that there is an agreement for arbitration, submits that it is possible that the respondent would also have a claim against the petitioner and therefor all contentions may be left open and a former Judge of this Court be appointed as the sole arbitrator. There is some argument on who the sole arbitrator must be, but this Court disposes of the petition by the following. - 4 - HC-KAR CNR: KAHC010072032026 NC: 2026:KHC:46229 CMP No. 50 of 2026 ORDER A. The petition is allowed, and Hon’ble Mr. Justice Sreenivas Harish Kumar, a Former Judge, High Court of Karnataka, is appointed as the sole arbitrator to enter reference of the dispute between the petitioner and respondent and conduct the proceeding at the Arbitration and Conciliation Centre [Domestic and International], Bengaluru according to the Rules governing the Arbitration and Conciliation Centre [Domestic and International], Bengaluru. B.
