: Mr. Aishwarya Dubey, Advocate For State : Mr. Vivek Sharma, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 08.10
.2026
1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 211/2026 registered at Police Station Shivrinarayan, District Janjgir-Champa (C.G.), for the offence punishable under Sections 109(1) read with 3(5), 115(2) read with 3(5), 296 read with 3(5), 351(3) read with 3(5) of BNS. 2. As per the case of the prosecution, an FIR was lodged on 02.07.2026 by one Shivnath Yadav, alleging that applicant along with Sahil Yadav and Swapnil Yadav demanded that Maheshwar Yadav be called to the Bus Stand. When Maheshwar Yadav arrived there, an altercation took place due to prior SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.10.08 16:45:01 +0530
2 enmity, and subsequently, Sahil Yadav using his metal bangle, inflicted injuries on his nose and head. The allegation against the present applicant is that he was in the company of Sahil Yadav and Swapnil Yadav. On such complaint, police registered an offence as stated above. 3. Mr. Aishwarya Dubey, learned counsel appearing for the applicant would submit that though there are three criminal antecedents against the applicant registered in the year 2025 and one case registered under the provisions of the Indian Penal Code in the year 2019, but only one case is presently pending. It is also argued that charge-sheet has already been filed, applicant is in jail since 19.08.2026 and allegation of assault is against Sahil Yadav. He would pray that the application be allowed. 4. On the other hand, learned counsel for the State would oppose the bail application. Mr.
Vivek Sharma, learned Panel Lawyer, would submit that present applicant along with the other two accused persons, in furtherance of their common intention, assaulted Maheshwar Yadav, who sustained serious injuries, and therefore, this application deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. According to the medical report, the injuries sustained by injured Maheshwar Yadav were simple in nature; charge-sheet has already been filed and the applicant is in jail since 19.08.2026. Though he has four criminal antecedents, at present, only one case under the provisions of the Indian Penal Code is pending and trial is likely to take some time for its conclusion, therefore, I am inclined to allow this bail application. 7. Accordingly, the regular bail application is allowed and it is directed that in
3 the event of the applicant executing a personal bond for a sum of Rs. 50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
