Mr. Prakash Chandra, learned counsel for the Appellant.

The present leave to appeal has been filed by the appellant under Section 419(4) of Bhartiya Nagrik Suraksha Sanhita, 2023 against the judgment and order dated 14.09.2023 passed by learned Judicial Magistrate-1st, Roorkee, District Haridwar in Criminal Complaint No.1263 of 2023 (Old No.1001 of 2017), Single & Company vs. Batra Associates, under Section 138 of Negotiable Instrument Act, Police Station Kotwali Manglour, District Haridwar.
3. Present leave to appeal is accompanied by an application for condonation of delay of 522 days in filing the leave to appeal
4. The appellant has explain the delay by stating that appellant did not have knowledge of technicalities and an old age person and due to this appellant could not file the present appeal within prescribed time limit.
5. Upon perusal of the application and the material placed on record, this Court finds that the explanation offered is neither satisfactory nor sufficient to justify such inordinate delay.
6. It is a settled principle of law that while courts may adopt a liberal approach in condoning delays, such discretion cannot be exercised in a routine manner, particularly where
the delay is substantial and remains unexplained or inadequately explained.
7. In the present case, the appellant has failed to demonstrate
“sufficient cause” for condonation of delay. The reasons assigned are lacking in particulars, and do not inspire confidence. No cogent material has been placed on record to substantiate the grounds urged.
8. In view of the above, this Court is not inclined to condone the delay. Consequently, the application for condonation of delay is dismissed.
9. As a result, the leave to appeal, being barred by limitation, also stands dismissed.
