Serial No. 64 Supplementary Cause List HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CRM (M) No. 821/2026 CrlM No. 1873/2026 Charan Jeet Singh … Petitioner(s) Through: - Mr Mubashir Gatoo, Advocate. V/s Union Territory of J&K and Ors. … Respondent(s) Through: - Mr Numan Idrees Malik, Government Advocate for R-1 & 2. CORAM: Hon’ble Mr Justice Yash Paul Bourney, Judge. (ORDER) 06.10.2026 01. After hearing the learned Counsel for the Petitioner for a while, it has been observed that the trial of the case before the Trial Court is in the midway and most of the material witnesses, including the victim, have already been examined. Therefore, the grounds projected in the present Petition truncating the charge sheet at threshold could have been first agitated by the Petitioner before the Trial Court, by laying an appropriate motion. 02. It, however, appears that the timeline for the disposal of the charge sheet arising out of the Prevention of Children from Sexual Offences (POCSO) Act, as provided in Section 35, has already elapsed. In such circumstances, it would be in the fitness of things if there is no further delay in the conclusion of the trial. 03. In view of above, the instant Petition is dismissed at this stage, along with the connected CrlM. The Trial Court, however, is directed to make an endeavour to conclude the trial within a period of three months.
