IN THE HIGH COURT AT CALCUTTA [CIRCUIT BENCH AT PORT BLAIR] ***
CRR/45/2026
Prakash Chimanlal Sheth
Vs
Rameshkumar Gordhanbhai Kathirai and another
Ms.Rashi Sheth (through virtual mode) Mr. Pardeshia Munda
… for the petitioner
Mr. Sumit Kumar Karmakar … for the respondent No.2 September 03, 2026 [AKB] Item No.4
1. Learned advocates for the parties are present. Heard learned advocates.
2. The grievance in the instant application is that the learned Trial Judge erred in dismissing the prayer of the petitioner by order dated 07.11.2025 although there was a direction by the writ court in judgement and order dated 10.02.2025 passed in WPA/614/2024 and WPA/616/2024.
3. Learned advocate submits that in order dated 10.02.2025 passed in the writ application there was a mistake in the date where learned Judge instead of observing that order dated 18.04.2023 being set aside in CR No 62 of 2018 by mistake has stated the CR No. 62 of 2018 and order dated 18.04.2024. As the order dated 10.02.2025 passed in WPA/616/2024 along with WPA/614/2024 is modified and clarified by order dated 03.09.2026, the learned Trial Court is directed to reconsider the earlier application made by the petitioner as expeditiously as possible.

4. Thus the order dated 07.11.2025 passed by the learned JMFC-I at Port Blair in CR Case No. 62/2018 is set aside with a direction to reconsider.
5. CRR/45/2026 stands disposed of.
