THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: a. Issue a Writ in the nature of Certiorari to set- aside/quash the joint compromise petition fraudulently took the signatures of the petitioner by the respondents dated 25.06.2022 vide Annexure- B; b. Issue writ in the name of Certiorari quash the award passed by the trial court in O.S.No.554/2022 passed by the 1st Additional Senior Civil Judge, Bengaluru Rural District at Bengaluru vide dated 15.07.2022 vide Annexure-C; c. Consequently remand the matter to trial court, to give an opportunity to the petitioner to conduct the case on merits and dispose the matter for afresh. d. Pass such other order or directions as this Hon'ble Court deems fit on the facts and circumstances of the case, in the interest of justice and equity. 2. The Petitioner had filed a suit in O.S.No.554 of 2022 seeking for partition and separate possession. In the said suit before the National Lok Adalat held on 25.06.2022 a Joint Compromise Petition had been filed. The presence of the parties was recorded; - 3 - HC-KAR CNR: KAHC010471072026 NC: 2026:KHC:47547 WP No. 21410 of 2026 compromise was taken and a decree directed to be drawn up in terms thereof. It is this compromise petition that the petitioner is challenging before this Court. 3. The submission of learned counsel for the petitioner is that in the National Lok Adalat there was heavy crowd and when the petitioner was asked to sign the document, a different document was given to the petitioner to sign, and the petitioner signed the same. 4. The petitioner having been represented by a counsel in the proceedings, being plaintiff having signed the compromise petition in the year 2022, merely on the ground that there was a heavy rush in the National Lok Adalat and the petitioner could not read the compromise petition, cannot be a ground to entertain such a petition after more than four years. If such a ground is to be accepted, no compromise petition signed before the National Lok Adalat can be accepted. 5. No grounds being made out, the petition stands dismissed.
