The petitioners Gaurav Singh Fartyal and Hemant Singh Fartyal preferred instant writ petition for quashing of first information report dated 03.01.2026 bearing FIR No. 0008 of 2026, P.S. Sitarganj District Udham Singh Nagar wherein they have been implicated for the offences punishable under Sections 117(2), 191(1) and 351(3) of Bharatiya Nyaya Sanhita, 2023. 5. The writ petition is supported with the compounding application along with the affidavit of the petitioners and the complainant/ respondent no.3 Mr. Himanshu Giri with this contention on the date of incident for minor issues there were some hot talk in between them, and now that they have amicably settled their disputes and their relations are very cordial and the complainant does not want to pursue with the impugned FIR. Both the petitioners and respondent no.3 are present in Court and identified by their respective counsels. 2026:UHC:2216 6. This Court also interacted with the complainant who submits that he does not want to pursue with the impugned FIR and want to close the proceedings. 7. On the other side, Mrs. Meenakshi Sharma, the learned Brief Holder submits that the all the offences are compoundable and the investigation is still going on, however, since the parties have settled their dispute amicably, therefore, no useful purpose to go with the investigation. 8. After hearing the arguments of learned counsel for the parties and taking into consideration the averments as made in the compounding application and the fact that both the parties have settled their disputes and their relations are cordial, this Court is of the view that the writ petition as well as the compounding application deserved to be allowed. 9. Accordingly, the writ petition as well as the compounding application are allowed and the impugned FIR 03.01.2026 bearing FIR No. 0008 of 2026, P.S.
