1 CGHC010362652026 2026:CGHC:43496 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 8856 of 2026 Ram Kumar Kujur S/o Shri Suresh Kumar Kujur Aged About 27 Years Chhatta Sarai, Distt. Jashpur Chhattisgarh ... Applicant(s) versus State Of Chhattisgarh Station House Officer Police Station Lailunga Distt. Raigarh Chhattisgarh ... Non-Applicant(s) For Applicant : Ms. Bulbul Agrawal, Advocate. For Non-Applicant/State : Ms. Ankita Shukla, Panel Lawyer. Hon'ble Mr. Rakesh Mohan Pandey, Judge Order on Board 07/10/2026 1. The applicant has preferred this first bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail, as he has been arrested in connection with Crime No.69 of 2026 registered at Police Station Lailunga, District Raigarh (C.G.), for the offences punishable under Sections 20(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The prosecution case, in brief, is that on 01.03.2026, on the basis of secret information, the police intercepted a Maruti Suzuki Ritz car KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 bearing registration No. CG-13-UG-9683 near Atal Chowk, Pakargaon, in which two persons, namely Shrawan Kumar Nishad and Mahendra Prasad Chauhan, were allegedly found carrying contraband ganja. Upon search, ganja weighing 10.048 kg and 8.985 kg was allegedly seized from accused Shrawan Kumar Nishad and ganja weighing 10.082 kg was seized from Mahendra Prasad Chauhan. During the course of investigation, co-accused Sadanand Bhatt was also interrogated and his memorandum statement was recorded, wherein he allegedly disclosed that he along with present applicant Ramkumar had purchased ganja from Odisha for sale and had brought the same in the car of Shrawan Nishad. Thereafter, the present applicant was arrested in connection with the aforesaid offence. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the present case. He would submit that no contraband has been seized from the possession of the applicant and that on the date of the incident, the applicant was not travelling in the alleged vehicle. It is further submitted that the applicant has been implicated solely on the basis of the memorandum statement of co-accused Sadanand Bhatt. He would further submit that the charge-sheet has already been filed before the competent Court and the applicant has remained in custody since 02.08.2026 and has no criminal antecedents and the conclusion of the trial is likely to take some time therefore, he prays for grant of regular bail. 3 4. On the other hand, learned State counsel would oppose the prayer for grant of bail and submit that the bail application of similarly situated co-accused Sadanand Bhatt has already been rejected by a Coordinate Bench of this Court in MCRC No.7074 of 2026 vide order dated 04.08.2026. He would further submit that although no contraband has been seized from the present applicant, the offence involves an organised manner of transportation and sale of ganja. It is further submitted that the contraband seized from the co-accused is above commercial quantity and therefore, the rigors of Section 37 of the NDPS Act are attracted. Hence, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary and other material available on record. 6. Having considered the facts and circumstances of the case, nature and gravity of offence alleged against the applicant, the fact that the contraband was seized from the other co-accused and not from the possession of present applicant and further considering that at the time of seizure, the applicant was not travelling in the said vehicle, charge-sheet has already been filed before the competent Court, the applicant has remained in custody since 02.08.2026 and has no criminal antecedents, thus without further commenting upon the merits of the case, I am inclined to grant bail to the applicant. 7. Accordingly, the bail application of the applicant is allowed. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the 4 satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. - S/- Sd/- (Rakesh Mohan Pandey) Judge Kunal
