1. Learned advocates for the parties are present. Heard learned advocates for the parties.
2. The grievance of the writ petitioner is that his application made to the Sub Divisional Officer, South Andaman, Sri Vijaya Puram for permission to divert the land in any holding for alternative use is kept pending for one year without a decision being taken on the same.
3. In the facts and circumstances this Court is of the view that no fruitful purpose will be served by keeping this writ petition pending and directing for filing of affidavits.
4. Thus this writ application stands disposed with a direction upon the respondent No.2 the Sub Divisional Officer, South Andaman, Sri Vijaya Puram to consider and decide the application of writ petitioner for permission to divert land in any holding alternative use marked annexure P2 to this writ application within a period of five weeks from the date of communication of this order upon giving the writ petitioner and his learned advocate an opportunity of being heard.
