Appeal is at the behest of one of the defendants in the suit. A money decree was passed by the impugned judgment and decree against the defendants to the suit which includes the appellant. There is a delay in making and filing the appeal. Delay is to the extent of 921 days. 2 Department reports that, the appeal was filed with deficit Court fees. Appellant is yet to put in the Court fees of Rs.23,880/- for the purpose of the present appeal. Noticing such fact, we permitted the appellant time to put in the deficit Court fees. Today learned Advocate appearing for the appellant submits that, the appellant is unable to put in the deficit Court fees for the appeal. Plaintiff and one of the defendants in the suit are represented.
