The petitioner is apprehending his arrest in connection with Hunterganj P.S. case no. 199/2025, offence registered under sections 317 (2), 3(5) of the BNS and 4/21 MMDR Act, 54 of JMMCR, 13 JMPIMT & Storage Act, pending in the Court of learned Judicial Magistrate, 1st Class, Chatra. 3. Learned counsel appearing for the petitioner submits that petitioner happened to be the driver of Hywa truck and the allegation is made that 500 cft. stone chips was loaded on the said truck. He also submits that the owner of the said truck has been granted anticipatory bail by the learned Sessions Judge and refused to grant anticipatory bail to the petitioner. He next submits that the petitioner has got no criminal antecedent as disclosed in para 16 of the petition. 4. Learned counsel appearing for the state opposed the prayer and submits that the petitioner happened to be the driver of the said Hywa truck, on which the stone chips was illegally loaded. 5. Considering that the petitioner is the driver of the Hywa truck 2026:JHHC:1238 2 in question and the owner of the said Hywa truck has been granted anticipatory bail by the learned Sessions Judge, petitioner has got no criminal antecedents as disclosed in para 16 of the petition and in course of argument, it has been pointed out that the petitioner is driving the said Hywa truck to earns his livelihood, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra, in connection with Hunterganj P.S. Case no. 199/2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
