Order on Board 08.10.2026
1. Petitioner has filed this writ petition seeking following reliefs:-
“ 10.1 That, this Hon’ble High Court may be kind enough to call for entire records pertaining to the case of petitioner, in the interest of justice.
10.2. That, this Hon’ble Court may be kind enough to direct respondent authorities to finalize the selection procedure instituted against advertisement dated 20.10.2023 for direct recruitment on the post of Constable (GD) in the light of letter dated 17.08.2026 and issue appointment order to the petitioner, in the interest of justice.
10.3. That, this Hon’ble Court may be kind enough to declare the petitioner’s domicile certificate valid and further direct the respondent authorities to consider the same for petitioner’s appointment on the post of
3 Constable (GD) in Bemetara District, in the interest of justice
10.4. That the Hon’ble High Court may be kind enough to declare candidature of the petitioner fit for recruitment on the post of Constable GD in Bemetara District, in the interest of justice.”
2.
Learned counsel for the petitioner submits that the petitioner’s name finds place at Serial No. 2 in the waiting list published on 09.12.2025 in respect of the recruitment process for the post of Constable (G.D.), which was conducted during the year 2023-2024 for recruitment to the post of Constable (G.D.) in Durg Range, District Durg. Learned counsel further submits that the candidates included in the waiting list were called for verification of their documents. Pursuant thereto, the petitioner appeared before the concerned authority for document verification and submitted his domicile certificate, issued by the competent authority on 02.08.2013, vide Annexure P/6. However, the appointment order has not been issued to the petitioner on the ground that the recruiting agency/concerned authorities are verifying the status and genuineness of the domicile certificate produced by the petitioner at the time of document verification.

3.
Learned counsel for the petitioner, by referring to Annexure P/10 dated 17.08.2026, submits that the domicile certificate produced by the petitioner was not found to be recorded in the records/register of the office of the Tehsildar, Bilaspur and for the said reason they are verifying the domicile certificate dated 02.08.2013 produced by the petitioner. It is further submitted that the petitioner has already produced a fresh domicile certificate before the competent authority. The Superintendent of Police, Bemetara, has also sought guidelines from respondent No. 3, vide communication dated 17.08.2026 (Annexure P/10), as to whether the appointment
order can be issued in favour of the petitioner on the basis of the fresh domicile certificate.
4.
Learned counsel for the petitioner, referring to the judgment passed by the Division Bench of this Court in Narendra Kumar v. State of Chhattisgarh & Others, in W.A. No. 251/2021, decided on 16.06.2023, submits that production of a domicile certificate is not a pre-requisite for recruitment to the post of Constable (G.D.). It is, therefore, submitted that the petitioner’s candidature may be considered and the appointment order may be issued, particularly when the
5 petitioner has already produced a fresh domicile certificate before the competent authority.
5.
Learned counsel appearing for the State submits that the Superintendent of Police, Bemetara, had sought guidelines from respondent No. 3 vide communication dated 17.08.2026, as the domicile certificate produced by the petitioner was not found recorded in the register maintained by the Tehsildar, Bilaspur. It is submitted that the relevant records are being verified and, therefore, the appointment order has not yet been issued in favour of the petitioner.
6. I have heard learned counsel for the parties and perused the material available on record.
7. Considering the submissions made by learned counsel for the parties and the fact that the petitioner has already produced a fresh domicile certificate before the competent authority, this Court finds that the issue relating to verification of the earlier domicile certificate dated 02.08.2013 need not come in the way of consideration of the petitioner’s candidature. It is also relevant to take note of the judgment passed by the Division Bench of this Court in W.A. No. 251/2021, wherein it has been
6 held that production of a domicile certificate is not a pre- requisite for recruitment to the post of Constable (G.D.).
8. Accordingly, the respondents are directed to consider the fresh domicile certificate produced by the petitioner and, keeping in view the judgment passed by the Division Bench of this Court in W.A. No. 251/2021, consider issuance of the appointment order in favour of the petitioner for the post of Constable (G.D.), in accordance with his position at Serial No. 2 in the waiting list published on 09.12.2025, subject to verification that the petitioner is otherwise eligible and fulfills all other requisite conditions of appointment.
9. The aforesaid exercise shall be completed by the respondents within a period of 40 days from the date of receipt of a copy of this order.
10. Accordingly, the writ petition is allowed to the aforesaid extent. Sd/-
