ORAL ORDER
1. Petitioner is before this Court seeking for the following reliefs: a. Order, direction or Writ in Mandamus directing the Respondent to provide adequate Police Protection within a limited time frame, may be with machinery force to the Court Commissioner and to the Petitioner to take physical possession of the Schedule Property as per the
order dated 03.03.2025 passed in Crl.Misc.No.38/2025 by Learned III Additional Senior Civil Judge & C.J.M., Mysuru vide Annexure-C.
b. Pleased to direct the Respondent Police to submit compliance report in Crl.Misc.No.38/2025 by Learned III Additional Senior Civil Judge & C.J.M., Mysuru.
c. Pleased to pass any other order or direction as deems fit under the facts and circumstances of this case in the interest of justice.
2. A memo for withdrawal dated 29.08.2026 has been filed signed by the counsel for the petitioner, which reads as under:
"The Petitioner above-named respectfully submits as follows:
1. The Petitioner had preferred the top-noted Writ Petition under Articles 226 and 227 of the Constitution of India seeking appropriate directions against the Respondent / Talakadu Police to render necessary police assistance for enforcement and execution of taking physical possession of the secured asset under the provisions of the SARFAESI Act, 2002.
2. It is submitted that during the pendency of the present writ petition, the Respondent-Talakadu Police

Station-has provided the requisite police assistance to the Petitioner financial institution.
3. Consequently, the Petitioner has successfully taken physical possession of the secured asset in question, and the main grievance raised in the present writ petition stands fully resolved and satisfied.
4. In view of the above developments, the purpose of filing the present Writ Petition has been served, and the prayers sought therei have rendered infructuous.
5. Therefore, the Petitioner prays for leave of this Hon'ble Court to withdraw the present Writ Petition as non-prosecuted, in the interest of justice and equity. PRAYER WHEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to: Permit the Petitioner to withdraw Writ Petition No. 6018 of 2026; and Pass such other order or orders as this Hon'ble Court deems fit in the circumstances of the case, in the interest of justice and equity. "
3. Accepting the said memo and the submission of the counsel for the petitioner, the petition is dismissed as withdrawn.
