(2) This writ petition was disposed of, vide order dated 20.3.2026, by directing the Director, Urban Development to take decision on petitioner’s representation within three months. Today, the matter is listed on modification application (MCC/ 15300/ 2026). (3) It is contended that this Court in Writ Petition (S/ S) No. 924 of 2019 has decided similar issue, therefore the competent authority be asked to take decision on petitioner’s representation in the light of the judgment rendered in the said writ petition. It is further contended that instead of Director, Urban Development, Secretary, Urban Development be asked to take decision on petitioner’s representation, as he alone can take decision in the matter. (4) Learned State Counsel, however, refers to Government Order dated 14.11.2024 for contending that because of the amendment, arrears of
family pension would not be payable. He, however, submits that he has no objection if the order dated 20.3.2026 is modified in terms of prayer made by petitioner/ applicant. (5)
Order dated 20.3.2026 is modified by providing that petitioner shall make representation to the Secretary, Urban Development within two weeks from today. Representation, if made within stipulated tim e, shall be decided by the Secretary, Urban Development within three months thereafter. While taking decision, Secretary, Urban Development shall bear in mind the judgment rendered by this Court in Writ Petition (S/ S) No. 924 of
2019. (6) Modification application stands
disposed of accordingly.
