NO.9988 OF 2026) ORDER :-(per Hon’ble Sri Justice Ravi Nath Tilhari) On 16.04.2026, the following order was passed :- “This petition has been filed by the father of the detenue said to be illegally detained by respondent Nos.5 and 6. 2. Sri J. Krishna Praneeth, learned Assistant Government Pleader attached to the office of the learned Advocate General, appearing for the respondents, submits that the detenue was produced before the Magistrate for remand and under the orders of such Court, the detenue has been released in Crime No.76/2026 registered under sections 196(1)(a), 352, 353(2), 336(1). 340(2), 61(2), 111 BNS, 67 ITA-2000-2008 of Kuppam Urban Police Station. 3. Let an affidavit be filed by respondent No.5. 4. Post in the next week.” 2. Pursuant to the order dated 16.04.2026, a counter affidavit has been filed by respondent No.6. 3. In the counter affidavit, it has been stated that the detenue was arrested on 14.04.2026 at 6:00 p.m. and was produced before the concerned Magistrate for remand on 15.04.2026 at 5:45 p.m and the learned Magistrate rejected the request for remand and ordered the release of the detenue. A copy of the order rejecting the remand has also been annexed to the counter affidavit. 4. In view of the above, the Writ Petition is dismissed as infructuous. 4 (RNT,J & SS,J W.P. At this stage, Sri Papudippu Sashidhar, learned counsel for the petitioner, submits that the petitioner’s arrest amounted to illegal detention and seeks liberty to approach the appropriate forum for appropriate relief. 6. It is always open to the aggrieved person to approach the competent Court/forum for appropriate relief in accordance with law. No separate direction in that regard is required from this Court. No order as to costs.
