The learned advocate representing the petitioner/defendant no.2 prays for expeditious disposal of the Title Suit being No.186 of 2019. 2. The learned advocate submits that the petitioner/defendant no.2 is an octogenarian and has been attending the Court since inception of the title suit that is since the year 2019 that is more than 7 years. 3. He further submits that the title suit has been fixed for acceptance of show-cause on 23.09.2026 while the show-cause has been filed on 22.07.2026. He further submits that the suit was fixed in the Peremptory Board 2 on 06.09.2024 and since then not a single witness has deposed, on the contrary the plaintiff has sought for amendment which has been allowed, amended plaint has been filed and an additional written statement has also been filed. 4. The learned advocate representing the opposite party/plaintiff submits that there is no laches on the part of the opposite party/plaintiff. As such, opposes the prayer for expeditious disposal. 5. Considering the submission of the learned advocates and on perusal of the ordersheets, it transpires that the suit was fixed for evidence on 06.09.2024 and thereafter amendment has been sought for by the plaintiff which has been allowed and amended plaint has been filed and additional written statement has also been filed. 6. Considering, the year of filing of the title suit that is 2019, the learned Trial Judge that is Civil Judge, Junior Division, Jalpaiguri, is requested to dispose of the suit as early as possible without granting any unnecessary adjournment to either of the parties. 3 7. As such, the civil revision application being C.O. 132 of 2026 is disposed of. 8. Urgent certified copy of the order be supplied to the parties if applied upon completion of all required formalities.
