31.08.2026 rc/ct.no.15 Item No.24 WPA No. 1224 of 2026 Ramicha Bibi @ Ramicha Bewa Versus The State of West Bengal & Ors. Adv. Sujit Kumar Bhuniya Adv. Jagadish Chandra Halder ..for the petitioner Adv. Bipul Kumar Mandal Adv. Puja Sonkar ….for the State Report submitted by the State is taken on record. The petitioner’s husband Arsad Ali Midder was appointed as Chowkidar in Patikhanpur Gram Panchayat and died in herness on October 15, 1992. The petitioner applied before the authority for issuance of family pension and other terminal dues of her husband which were not considered. The petitioner approached this Court in a writ petition being W.P.No. 19578(W) of 2006 and by an order passed on February 21, 2007, this Court directed the concerned authority to pay the admissible terminal dues of the petitioner’s husband including family pension and arrear family pension admissible to the petitioner within a period of 8 weeks from the date of communication of the
order, subject to compliance of all necessary formalities by the petitioner. This Court further directed that in the event the concerned authority failed to pay the aforesaid dues either on account of the deceased employee or on account
of the petitioner within the time frame stated in the order, the concerned authority would have to pay interest on the petitioner’s entitlement @10% per annum till the entire payment was made.
Learned counsel for the petitioner submits that no payment has been made to the petitioner till date despite the order of this Court. It appears from the report submitted by the State that the Block Development Officer, Hasnabad, North 24 Parganas has forwarded the prayer of the petitioner with regard to the family pension along with relevant documents to the Director, Pension, Provident Fund and Group Insurance, Finance Department on August 03,
2026. The report is silent with regard to the admissible terminal dues of the petitioner’s husband. The petitioner has been waiting to receive such dues from 1992. In view of the above, the Director, Pension, Provident Fund and Group Insurance, West Bengal, being the 2nd respondent herein is directed to sanction the admissible terminal dues of the petitioner’s husband as well as family pension and arrear family pension admissible to the petitioner within six weeks from the date of communication of this order and send the same to the Treasury Officer, Basirhat, being the 9th respondent herein, for taking consequential steps. The 9th respondent is
directed to take such steps within two weeks from the date of receipt thereof. 2
The concerned authorities shall pay 10% interest per annum to the petitioner on the said dues from the date of her entitlement till payment of the entire amount. With the above observation and direction, this writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 3
