THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: I. Issue a Writ in the nature of Mandamus directing the Respondent No.2 - Principal Secretary, Revenue Department, being the competent authority under Section 197 Cr.P.C., to consider and dispose of the petitioner's representation dated 15-09-2022 vide Annexure-D, E and F seeking sanction to prosecute the concerned revenue officials, within a time frame to be fixed by this Hon'ble Court; II. Direct the respondent authority to pass a reasoned and speaking order in accordance with law; III. Grant such other reliefs as this Hon'ble Court deems fit. 2. The petitioner is before this Court contending that the representations which have been submitted by the petitioner on 15.09.2022 at Annexure-D, D1, E, E1, F and F1 has not been considered by the respondent. 3. Whenever a representation is submitted by a citizen to an authority, it is required for the authority to - 3 - HC-KAR CNR: KAHC010314422026 NC: 2026:KHC:47542 WP No. 14417 of 2026 consider the same and pass necessary orders either accepting or rejecting said representation, in both cases accompanied by reasons. 4. The representations of the petitioner has been pending for last 4 years, no action has been taken by respondent. As such, this Court passes the following; ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondent No.2 to consider the representation dated 15.09.2022 at Annexure-D, D1, E, E1, F and F1 and pass necessary orders within a period of 60 days from the date of receipt of the copy of this order. iii. It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner and the same would have to be independently considered by respondents in accordance with the law.
