C.R.M. (NDPS)1899 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Marishda Police Station Case No.167 of 2025 dated 04.05.2025 under Sections 20(b)(ii)(c)/29/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Baby Roy Versus The State of West Bengal
Mr. Amal Krishna Samanta Ms. Mohua Palit. …for the petitioner.
Dr. Achin Jana Mrs. Rima Banerjee. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 1 year 4 months, charges have already been framed and there is no possibility of the trial being concluded in near future, as such, petitioner may be released on bail.
Learned advocate for the State opposes the prayer for bail and submits that from the joint possession of the present petitioner and another 53.52 kgs. of ganja were recovered. There has been no delay on the part of the prosecution. As such, prosecution would be seriously prejudiced in case the petitioner is granted bail.
Having considered the quantum of recovery from the joint possession of the petitioner, I am of the opinion that rigors of
2 Section 37 of the NDPS Act is attracted.
As such, the prayer for bail of the petitioner in CRM(NDPS)1899 of 2026 is rejected.
Memo of Evidence submitted by the State be kept with the record.
