In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Lalgola Police Station Case No. 308/2025 dated 10.04.2025 under Sections 65(2)/351(2) of the BNS, 2023 read with Section 6 of the POCSO Act. ….for the State. Evidence of the victim placed by the learned advocate for the petitioner be kept with the record. I have taken into account the materials appearing in the case diary including the statement of the victim. Records reflect victim has corroborated the accusations. Prosecution intends to examine 17 witnesses. Till date 8 witnesses have been examined. Some time will be required to complete rest of the witnesses. Records also reflect that the petitioner is in custody for 1 year and 4 months. 2
Having considered the totality of the circumstances including the period of detention of the petitioner as well as the fact that the time which will be required to take the trial to its logical conclusion, without entering into the merits of the case, I am inclined to release the petitioner on bail because of the period of incarceration. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Sawkat Ali @ Soket shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court. Additionally, petitioner shall stay outside the jurisdiction of Lalgola Police Station and will enter the jurisdiction only for the purposes of attending the Court proceedings. With the aforesaid observations CRM (M) 1415 of 2026 is allowed. Photostat copy of the evidence be kept with the record. 3
