JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner - accused No.3 is before this Court calling in question registration of a crime in Crime No.34/2024, pending before the XXXII Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 498A, 506 r/w. 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. - 3 - HC-KAR NC: 2026:KHC:20853 CRL.P No. 5351 of 2024 2. Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a joint application under Section 359 r/w. 528 of the BNSS, 2023 along with affidavits of both the parties seeking permission to compound the offences, before this Court. 3. The joint application reads as follows: “2. In view of the settlement between the parties, the Respondent No.2 undertakes to withdraw all the cases filed against the petitioner including the present case, whatever allegations is made by the complainant in Cr. No.34/2024 under section 498A, 506 r/w. 34 of IPC and Sec. 3 & 4 of D.P. Act. of North Women P.S. which is pending on the file of XXXII ACJM, Bengaluru City against the petitioner is withdrawn and 2nd respondent has no objection to quash the proceeding against the petitioner. 3. The Petitioner and Respondent No.2 submits before this Hon'ble court that the above application is filed without any force, coercion or undue influence for any person/s. 4. The Petitioner and 2nd Respondent submits before this Hon'ble court may be pleased to compound the offences and quash the proceedings in of North Women P.S. Cr No.34/2024, under section 498A, 506 r/w. 34 of IPC and Sec. 3 & 4 of D.P. Act. against the petitioner which is pending on the file of XXXII ACJM, Bengaluru, in the interest of justice.” In the light of the afore-quoted application, the fact that it is a matrimonial dispute and as the allegations are not against the State, I deem it appropriate to permit the parties to compound the offences and terminate the proceedings against the petitioner. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.34/2024, pending before the XXXII Additional Chief Judicial Magistrate, Bengaluru, qua the petitioner, stands quashed.
